Wisconsin Supreme Court Addresses Direct Action Against Insurers & Corporate Officer Liability
The Wisconsin Supreme Court decided Casper v. American International South Ins. Co., 2011 WI 81 (July 19, 2011), no longer requiring a liability insurance policy to be delivered or issued for delivery in Wisconsin for a party to sue an insurer directly, as long as the accident or injury occurs in Wisconsin. Additionally, the Court refused to completely bar claims for personal liability against corporate officers for negligent acts committed in the scope of employment.
